1. What You're Agreeing To

By using Thuban (the CLI tool, VS Code extension, MCP server, GitHub Action, dashboard, or website), you agree to these terms. Thuban is provided by Silverwings Benefits Ltd, a company registered in England and Wales.

If you don't agree with these terms, don't use the software. We won't be offended.

2. Your Account

The free tier doesn't require an account. You can install Thuban via npm and start scanning immediately. Paid tiers require an account with a valid email address.

You're responsible for keeping your account credentials secure. If you suspect unauthorised access, contact us immediately at support@thuban.dev.

3. Pricing and Plans

Thuban offers the following plans:

Prices are in USD. We reserve the right to change pricing with 30 days' notice. Existing subscribers keep their current price for at least 12 months after any change.

4. Cancellation and Refunds

Cancel anytime. There are no lock-in contracts, no cancellation fees, and no exit interviews. You can cancel your subscription from your dashboard or by emailing us.

14-day refund policy. If you're not satisfied with a paid plan, request a full refund within 14 days of your initial purchase. No questions asked. After 14 days, we'll prorate any remaining time if you cancel.

5. Your Code and Data

Your code is yours. Thuban runs locally on your machine. We never see, access, store, or claim any rights to your source code. The scan results you choose to push to the dashboard are stored on your account and can be deleted at any time.

6. Acceptable Use

You agree not to:

• Use Thuban for any illegal purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble the obfuscated build of Thuban
• Redistribute, resell, or sublicense Thuban without written permission
• Use Thuban to attack, disrupt, or gain unauthorised access to other systems
• Circumvent usage limits or authentication mechanisms
• Misrepresent your identity or affiliation when using the service

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

Thuban, including its source code, detection rules, Crucible engine, documentation, and branding, is the intellectual property of Silverwings Benefits Ltd. The software is licensed, not sold.

The free and paid tiers grant you a non-exclusive, non-transferable licence to use Thuban for your own development purposes. This licence does not grant you ownership of the software.

8. Disclaimer of Warranties

Thuban is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the software will be error-free, uninterrupted, or that it will detect every possible issue in your code.

Thuban is a development tool, not a guarantee of code quality. You remain responsible for testing, reviewing, and validating your code before deploying it to production.

9. Limitation of Liability

To the maximum extent permitted by law, Silverwings Benefits Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of Thuban.

Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim. For free tier users, our maximum liability is zero.

10. Service Availability

The Thuban CLI runs locally and does not depend on our servers. It will continue to work even if our website or dashboard is temporarily unavailable.

For the dashboard and online services, we aim for 99.9% uptime but do not guarantee it. We will provide reasonable notice of planned maintenance.

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email (for account holders) and noted in the changelog. Continued use of Thuban after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of Thuban shall be subject to the exclusive jurisdiction of the courts of England and Wales.
